Fatal Shuttle Bus Accident At Honolulu Cruise Terminal Leaves One Dead, Several Injured

Hawaii shuttle bus accident

Friday, April 12, a shuttle bus accident occurred at a Honolulu cruise terminal, leaving one person dead and several others injured.

Hawaii shuttle bus accidentAccording to police and Carnival Cruise Line, the cruise port bus was dropping off passengers near a pier when the accident occurred. A bystander noticed the bus was moving forward and informed the driver. The driver then jumped into the driver’s seat in an attempt to stop the bus. However, the driver pressed the gas pedal rather than the brakes.

As the bus charged forward, it struck 11 people and several concrete barriers before hitting a wall and stopping. According to police, five of the eleven people who were struck were transported to hospitals for treatment, while the other six refused treatment.

The one woman who died from the injuries she sustained in the accident was attending the cruise to celebrate her wedding anniversary with her husband. The pair is from Illinois. Her husband is among those who were injured, and he is expected to recover. He was taken to the emergency room along with several other members of their family who were accompanying them on the cruise.

Carnival Cruise Line said nine of those injured in the accident were guests from the Carnival Miracle ship that was docked there. The ship set out from Long Beach, CA, and was midway through a 15-day sailing trip when this accident occurred.

The Honolulu Police Department stated that police will continue to investigate the cause of this accident to determine if drugs or alcohol were contributing factors to causing the accident.

The Impact Of Personal Injuries

Personal injuries, like those seen in the accident above, can occur almost anywhere at any time. Personal injuries often result in physical injuries and property damage, but in some cases, they may even lead to death, as was the case for one woman in the story above.

“Our hearts go out to the family whose celebration of love turned into the sudden loss of their loved one,” says lawyer Paul Starita, of Singleton Schreiber, “In accidents such as the one that occurred Friday in Honolulu, it may be best for victims or their families to acquire the assistance of a skilled personal injury attorney to help them mitigate the financial impact the accident has on them moving forward. While no amount of money can bring their loved one back, or reverse their injury, it is important that they, and others like them, know they may have legal recourse that can help lessen the financial burden they bear.”

The impact of personal injuries on victims and their families may include:

  • Emotional toll – the trauma of the accident, the ongoing pain and recovery, or the loss of a loved one can lead to mental health challenges like anxiety and depression, among others.
  • Financial burden – medical bills coupled with lost wages due to the inability to work during recovery or a long-term disability, or funeral costs and the loss of financial support the deceased provided their family.
  • Long-term consequences – long-term or permanent disabilities may cause the injured to need ongoing medical care, rehabilitation, or assistive devices. Their injury may also impact their ability to pursue their career or hobbies they once enjoyed.

Denver Fire Damages Three Homes and Six Structures

Denver home fire

Late morning on Saturday, April 13th, Denver Fire Department firefighters were made aware of two structures on fire on West 39th Avenue and Clay Street around 11:45 am.

Denver home fireOnce the initial firefighters arrived and assessed the scene they called for more firefighters and were able to get the fire under control. In total, 75 firefighters were on the scene helping to control the fire.

According to the Denver Fire Department, nine buildings total were involved – three homes and six detached garages.

Fortunately, no one was injured in the fire. One firefighter was evaluated for smoke inhalation but was able to quickly return to work.

Local news reports shared that one family was displaced from their home, while the other two homes sustained damage only to the outside of the structures.

A fire department spokesperson reported neighbors said they heard a loud explosion just before the fire started. The department is investigating the fire to determine the cause.

What Legal Options Do Victims Of Fires Have?

The aftermath of experiencing a residential fire can be devastating both emotionally and financially. Residential fires can cause extensive damage, cause you to lose some or most of your belongings, and may leave you with injuries, depending on the circumstances.

Victims of residential fires may have legal recourse, depending on the cause of the fire. After the fire, victims tend to file a claim with their insurance. Unfortunately, insurance claims are not always a smooth process.

Insurance companies’ main priority is to protect their bottom line, and this means they may offer victims lowball settlements, flat-out deny policy holder’s claims, or unreasonably delay processing or payment.

In other cases, the fire the victim experienced may be due to the negligence of another person or entity.

In either case, it is likely in the victim’s best interest to hire a lawyer with experience handling insurance claims and property damage claims.

“What the family in Denver has gone through is devastating,” says Kevin Hannon, an attorney at Singleton Schreiber, “our hearts go out to the family affected by this incident. I’ve seen firsthand how the aftermath of a fire like this can impact victims. It’s important that law enforcement determine the cause so that the family can get the justice they deserve.”

Safety Tips To Help Prevent Fires and Minimize Damages

Victims of fires potentially have a lot to lose, including their belongings, their home, pets, and even their own lives. In the aftermath of such tragedies, the importance of incorporating fire prevention methods fire prevention methods is highlighted. Some things that can be done to help prevent fires include:

  • Installing and maintaining smoke alarms throughout your home
  • Develop and practice a fire escape plan with your family
  • Exercise caution with cooking appliances and heat sources
  • Properly store flammable materials
  • Regularly inspect electrical wiring and outlets for signs of wear or damage
  • Ensure any and all electrical work is done by a licensed professional
  • Monitor power lines and promptly report any signs of damage, wear, or sparking
  • Request for your electric company to conduct regular inspections and maintenance for electrical infrastructure

Incorporating these tips can help mitigate the risk of fires and help keep you and your loved ones safe.

Fire in Los Angeles Vacant Building Quickly Extinguished

Los Angeles vacant building fire

Just before 9:30 pm Saturday, April 13th, Los Angeles Fire Department (LAFD) firefighters were dispatched with a report of a house fire. The house, located in the 300 block of W 82nd Street in the Florence neighborhood, was vacant.

Los Angeles vacant building fireAccording to LAFD, 40 firefighters had extinguished the fire in just over 15 minutes.

Shortly after arriving on the scene, firefighters found a female civilian wounded outside the building. She was transported to a local hospital by LAFD paramedics. Her connection to the fire is unknown. No other individuals were found in or around the structure.

LAFD is currently working to determine the cause of the fire and the connection of the woman found outside the home.

Understanding Premises Liability: Responsibilities and Legal Implications

The aftermath of the recent fire incident in Los Angeles this week highlights the importance of the legal concept of premises liability and the role it plays in cases like these. Premises liability refers to the legal responsibility of property owners to ensure the safety of individuals on their property– including tenants, visitors, and trespassers. Yes, even trespassers are owed a certain level of care in California.

Property owners must identify and mitigate potential hazards on their premises, including slippery floors, uneven walkways, or inadequate security measures. Failure to fulfill this duty can result in their legal liability should someone be injured due to their negligence.

In California, property owners owe the highest duty of care to invitees and licensees on their property. Invitees include visitors, guests, and tenants. Licensees include customers and those involved in business. However, they also owe trespassers a certain duty of care, though not as high a duty as the other parties.

Trespassers are defined in California Penal Code 602 as someone who enters another’s property without permission or the legal right to do so. While they are not owed the same level of care as invitees or licensees, property owners cannot willfully or intentionally harm them.

Property owners may be held liable for trespassers injuries if:

  • The property contains an attractive nuisance and a child is hurt. An example of an attractive nuisance is a pool.
  • The property owner intentionally causes harm. An example of this would be a property owner setting a trap to injure a trespasser or using excessive force against a trespasser.
  • The property owner fails to warn of known damages. An example of this would be if a property owner knows people trespass fairly regularly and they create a dangerous condition, like digging a hole, that can purposely or accidentally harm trespassers. Property owners must post a warning sign or block off the area.

“The cause and circumstances of the fire that occurred in LA over the weekend are still unknown, but I’m confident the LAFD and LAPD will get to the bottom of it,” says Gerald Singleton, attorney at Singleton Schreiber, “Determining the cause and how the individual found on the scene was injured is essential to rectifying the situation.”

North County San Diego Weekend Crash Kills One Pedestrian and Injures Two Others

North County San Diego Weekend Crash Kills One Pedestrian and Injures Two Others

North County San Diego Weekend Crash Kills One Pedestrian and Injures Two OthersJust after 7:30 pm on Sunday, April 14th, a gray Toyota Corolla traveling eastbound on Oceanside Boulevard in Oceanside, California collided with three pedestrians crossing the road. The crash occurred 100 yards west of the College Boulevard intersection according to Sergeant Clint Bussey.

All three pedestrians that were struck were taken to local hospitals. One victim was pronounced dead at Tri-City Medical Center, and the other two were taken to Palomar Medical Center with non-life-threatening injuries.

Officials have withheld the identity of the deceased pedestrian so the family can be notified.

The driver of the vehicle remained at the scene of the crash. Bussey reported that the driver was not under the influence and that speed was not a factor in the cause of the collision.

Police are currently investigating the circumstances that lead to the collision.

Pedestrians Safety Tips

Pedestrians are vulnerable in accidents involving vehicles due to the sheer contrast in size and protection between a person and a moving vehicle. When a pedestrian is involved in a collision with a vehicle, the consequences can be severe, and in some cases, life threatening.

The primary reason pedestrians are so vulnerable is their lack of physical protection. Occupants in vehicles are surrounded by heavy metal frames, seat belts, and air bags, while pedestrians have little to no shield protecting them from the force of impact. As a result, even low-speed collisions can lead to significant injuries to pedestrians such as broken bones, internal organ damage, traumatic brain injuries, spinal cord injuries, and more.

“Pedestrians are at a disadvantage in terms of visibility and predictability,” says Brett Schreiber an attorney at Singleton Schreiber,  “Drivers are conditioned to anticipate the movements of other vehicles on the road, but pedestrians can be more difficult to predict and see, particularly in low light conditions, or when driver’s view is obstructed by objects like parked cars or foliage.

It is important for pedestrians to know they have rights, but to also exercise caution while walking. The accident that occurred in San Diego this weekend is tragic, our hearts go out to the victims and their families.”

Pedestrians can act unpredictably due to distractions or impairment. Similar to driving distracted or under the influence, maneuvering the road on foot while using phones or other electronic devices can reduce pedestrian’s awareness of their surroundings and increase the likelihood of accidents. Similarly, pedestrians under the influence of drugs or alcohol may exhibit impaired judgment and coordination, increasing their vulnerability on the road.

To mitigate the risk of accidents, pedestrians can take the following steps to help keep themselves safe:

  • Use designated crosswalks
  • Obey traffic signals
  • Look both ways before crossing any street
  • Make eye contact with drivers before crossing in front of them
  • Stay alert and aware of your surroundings
  • Walk facing traffic if no sidewalks are available
  • Make yourself as visible as possible by wearing bright clothes and reflective gear
  • Stay on sidewalks when they are available
  • Avoid walking while under the influence

To mitigate the risks of being in a collision with pedestrians, drivers can take the following steps to help keep pedestrians safe:

  • Be on the lookout for pedestrians, especially in areas like school zones, residential neighborhoods, and crosswalks
  • Adhere to posted speed limits, and slow down if there are pedestrians around
  • Avoid distracted driving
  • Give pedestrians the right-of-way at all times
  • Thoroughly check for pedestrians crossing the street before making a turn at an intersection
  • Be patient

Early Morning Wrong Way Crash on San Diego I-5 Leaves Two Dead

Early Morning Wrong Way Crash on San Diego I-5 Leaves Two Dead

Just after 3 am Wednesday, April 10, two people died in a wrong-way crash on the southbound I-5 in Chula Vista. The head-on collision occurred near North Palomar Street. Though the crash occurred in the early morning, it caused a serious delay in morning commuter traffic. All southbound lanes were closed while crews dispatched emergency response and clean up. The southbound lanes were reopened just before 9 am.

Early Morning Wrong Way Crash on San Diego I-5 Leaves Two DeadAccording to authorities, the wrong-way driver was a 67-year-old San Diego woman, traveling in the fast lane in a red Honda Civic. She was believed to be traveling at speeds between 80 to 90 mph. At around 3:20 am she collided with a Dodge Challenger, driven by a 16-year-old boy, who was traveling in the correct direction.

According to California Highway Patrol (CHP), drivers first started reporting the wrong way driver in the Camino de la Plaza area, which is over six miles south of where the accident occurred.

After the accident, the Dodge caught fire and was engulfed in flames. Both drivers were trapped in their vehicles and both unfortunately died at the scene. Their identities have not been disclosed.

This incident is under current investigation to determine the cause and the San Diego Medical Examiner’s Office is running a toxicology report to determine if drugs or alcohol contributed to causing this fatal accident.

Causes of Wrong-Way Driving and Collisions

On average, about 43 people are killed each year on California highways in wrong-way driving accidents. Often, these accidents occur late at night, between the hours of 6 pm and 6 am, and they tend to take place in the left-hand lanes.

According to a study conducted by the National Transportation Safety Board (NTSB), driver impairment is the number one cause of wrong-way collisions. Over 60 percent of drivers in fatal wrong-way collisions were considered to be drinking and have high BAC levels.

Other factors that may contribute to wrong-way driving and collisions may include:

  • Driver lack of awareness or confusion
  • Driver medical conditions or fatigue
  • Poor roadway design or infrastructure
  • And more

“The aftermath of wrong-way accidents can be devastating,” says Brett Schreiber, attorney at Singleton Schreiber, “they often have deadly outcomes like this one. Our hearts go out to the families that suffered losses today. While the San Diego Police investigate the circumstances of this crash, it is important that the families know they may have legal recourse and they may find it helpful to reach out to an attorney with experience in wrongful death and car accident claims.”

Safety Tips and What to Do If You See A Wrong-Way Driver

If you see a wrong-way driver, the number one thing to do is keep yourself safe. Do not attempt to stop them. Steps to take when you see a wrong-way driver include:

  • Move out of the way as quickly and safely as possible
  • Call 911 as soon as it is safe to do so, do not attempt to pursue the wrong way driver
  • Keep an eye out on the distant horizon, this will help you spot anything in the roadway ahead of time and give you time to maneuver out of the way
  • If you are driving at night, keep your headlights on so other drivers, especially wrong-way drivers, can see you

If you lost a loved one in a wrong-way driving accident, depending on the circumstances and details of the crash, you may be able to obtain compensation for wrongful death. Contact Singleton Scheiber today by calling (619) 771-3473 or emailing info@singletonschreiber.com for more information.

Pedestrian Dies After Being Hit By Car In NE Albuquerque

Pedestrian Dies After Being Hit By Car In NE Albuquerque

One man was killed in a pedestrian vs vehicle collision in NE Albuquerque, New Mexico, on Wednesday, April 10th.

Pedestrian Dies After Being Hit By Car In NE AlbuquerqueJust after 3 pm on Wednesday, an adult male was struck by a vehicle near the cross streets Louisiana Boulevard and Central Avenue NE. According to officials, the man died on the scene due to the injuries sustained in the collision.

Police say the man stumbled off of the curb into traffic when a white Buick SUV that was traveling north hit him. On-scene evidence reveals that the driver was not speeding and would not have been able to stop in time to avoid the collision. Police do not believe the driver was impaired at the time of the incident.

What Causes Accidents on the Road in Albuquerque

Albuquerque roads are among some of the most dangerous in the country. According to a US News report, Albuquerque has the highest fatality rate for drivers.  Data collected by Safe Roads USA found that in 2021 there were nearly 14,000 traffic accidents in Albuquerque, 243 of which were pedestrian accidents. This report also found that 95 percent of pedestrian accidents in the city result in injury or death for the pedestrian(s) involved.

“Pedestrian vs vehicle accidents can be devastating, as I’ve seen many times,” says Gerald Singleton, attorney at Singleton Schreiber. “Typically, drivers are found at fault for accidents involving pedestrians because of their duty to exercise reasonable caution and adhere to laws. However, in some cases, pedestrians may be found at fault if they jaywalk, are intoxicated, or suddenly dart into traffic. Regardless of who is at fault, these types of accidents usually take an emotional and financial toll on those involved and their families. It may be in their best interest to work with a pedestrian or car accident attorney, depending on their role in the accident.”

What are the most common causes of accidents in Albuquerque?

  • Distracted Driving— doing things like texting, talking on the phone, eating, talking with passengers, and other things that cause you to not pay attention to the road.
  • Failure to Yield the Right of Way— actions such as turning into or across traffic, running stop signs or red lights, or entering crosswalks when pedestrians or bicyclists are crossing.
  • Intoxication— driving while intoxicated can impair reaction times, and reduce coordination and perception. If pedestrians are intoxicated and dart into traffic, jaywalk, or enter an area where pedestrians are not allowed (like the highway) they may cause an accident.

Safety Tips For Pedestrians in Albuquerque

Because Albuquerque is a dangerous city for pedestrians, they should exercise caution when traveling by foot around the city. Actions pedestrians can take to stay safe include:

  • Use designated crosswalks – motorists are more likely to be looking for pedestrians in designated areas such as crosswalks
  • Obey traffic signals – wait for your turn to cross and ensure traffic has halted before entering the crosswalk or street
  • Stay alert – avoid distractions like using your phone or listening to music while walking so that you can be aware of your surroundings and react quickly if necessary
  • Be predictable – follow pedestrian rules and signals, avoid darting into traffic unexpectedly
  • Stay sober – walking under the influence of drugs or alcohol can cause you to act unexpectedly and make poor decisions, increasing the chances of causing or being involved in an accident
