Can you please let me know if I could port an EB3 EAD to a start up and file a new EB2 based on entrepreneurship
A friend of mine and I are building a product to start a company - start on our money and try for venture/angel funding. Can you please let me know if I could port my EAD to the new company and file a new EB2 based on entrepreneurship?

Not sure -- you stumped me :). What I meant to convey is that the question is nuanced enough, (and I think the law has recently changed), that you really need to go directly to an immigration attorney. I'm merely a business and IP attorney so this isn't my area of expertise.

On a seperate note - do you advise startups on legal aspects - incorporation etc? I was an employee for so long and now that I am planning to start something, I am trying to figure out what are the different steps to take. Sorry if the question is very basic.
To start a company and incorporating it as a C/S corp, would you need the person to a resident with a green card or can a person with EAD do that.

2. When was the I-140 (for EB3) approved and how long has his I-485 been pending?
3. How long did you spend on his H1b?

1. I am working on EAD right now
2. My 140 was approved in 2007 and 485 is pending for more than 3 years now
3. I was on an L1 B from 2004 to 2009 and then moved to EAD - I spent almost 5 years on the L1B
