This article looks at clues as to how Congress should answer a key question about the final structure of the crowdfunding legislation--namely, to what extent should a crowdfunding exemption preempt current or future state regulation which could impede the goals of the legislation. This article looks to the example of California--the most populus state, of course--and argues that the bill should be drafted more aggressive to prevent state regulation from undermining its goals.
