Match.com, eHarmony to Screen for Sex Offenders: Will Section 230 still apply?

Section 230 of the Communications Decency Act of 1996 provides immunity to websites and other entities from various torts committed by users of those services.  This article examines the recent trend of courts to limit the application of Section 230, and then points to the recent decision by certain online dating giants to screen for sex offenders as the types of steps which risk disqualifying those websites from claiming Section 230 immunity in the future.
