This article uses a brief recently filed before the United States Supreme Court to highlight how federal securities laws interact with the First Amendment right of free speech. The article uses the insights so gained to analyze the various securities law liberalizations passed by the JOBS Act and points out how far short the crowdfunding exemption so passed fell from the values underlying the right to speak freely.
