Crackberry Marks are Opposed by Blackberry

This article reviews a recent opinion in a trademark infringement action brought by Research in Motion (maker and trademark registration holder of Blackberry) against the maker of Crackberry-branded products.  The USPTO board's opinion in the case is reviewed and compared with other, similar cases to illuminate the contours of trademark law's fair use doctrine.
